Terms and Conditions

Welcome to the terms and conditions of www.strikks.nl. Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Before placing an order, if you have any queries relating to these terms and conditions, please contact STRIKKS designer knits at info@strikks.nl.
Each time you use our services, you acknowledge that you have read these Terms & Conditions and you agree to be legally bound by them. If you do not agree to be bound by these Terms, you may not use www.strikks.nl or the services provided by STRIKKS designer knits.

Terms and conditions in short:
  • By ordering any of our products, you agree to be bound by these terms & conditions;
  • In order to shop on strikks.nl, you must be at least 18 years old and not under guardianship;
  • All personal information you provide to us with or that we obtain will be handled by STRIKKS designer knits as responsible for the personal information;
  • Events outside STRIKKS designer knits’ control shall be considered force majeure;
  • The price applicable is that set at the date on which you place your order;
  • Shipping costs and payment fees are recognized before confirming the purchase;
  • Card information is transmitted over secure SSL encryption and is not stored;
  • Please note that local charges may occur;
  • STRIKKS designer knits reserves the right to amend any information without prior notice.
Article 1 | The following definitions apply to these conditions
  • Trader: STRIKKS designer knits; www.strikks.nl; the natural or legal person who is offering products and/or services to consumers over distance;
  • Consumer: the natural person who is not acting within the capacity of a profession or a business and enters into a distance contract with the trader;
  • Distance contract: a contract involving the sole use of one or more techniques for distance communication within a system organized by the trader for the distance sale of products and/or services, up to and including the moment that the contract is concluded;
  • Technique for distance communication: a means that can be used for concluding a contract, without the consumer and the trader being in the same place at the same time;
  • Withdrawal period: the period within which the consumer can make use of his/her right of withdrawal;
  • Withdrawal right: the possibility for a consumer to waive the distance contract within the withdrawal period;
  • Day: calendar day;
  • Extended duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or acquisition of which is spread over a period of time;
  • Durable medium: every means that enables the consumer or trader to store information that is addressed to him/her in person, in a way that permits future consultation and unaltered reproduction of the stored information.

Article 2 | Applicability

2.1 These general conditions apply to every offer from the trader and to every distance contract that is concluded between the trader and a consumer. The consumer will be provided with the text of these general conditions prior to the conclusion of a contract. The general conditions are available for inspection and they will be sent to the consumer, as soon as possible, at the consumer’s request.
2.2 These terms & conditions will always apply on every order. We may change these terms from time to time without noticing to you. Changes will apply to any subsequent orders received.

Article 3 | Acceptance of the agreement

3.1 If you are under 18 years old you must have parents’ permission to buy from STRIKKS.
All transfers conducted through STRIKKS are handled and transacted through third party dedicated gateways to guarantee your protection.
3.2 After accepting the order the buyer will receive an order confirmation which will be send to the given e-mail address. The order confirmation will quote all information about the ordered items and a summary of all costs.
3.3 Trader may refuse any order. If so, buyer will be notified within two business days after receiving the order.

Article 4 | Pricing, shipping and payment

4.1 Prices quoted for products or services being offered include 21% VAT.
4.2. Trader has the right to change the prices on the website at any time. The price applicable is that set at the date on which you place your order.
4.3 Costs for shipment are per order and per country and are for the buyer. Shipping costs and payment fees are recognized before confirming the purchase.
4.4 The costs for shipment when returning a product are for the buyer and will not be refunded by the trader.
4.5 All products remain STRIKKS’s property until full payment is made. Card information is not stored and all card information is handled over SSL encryption.

Article 5 | Delivery

5.1 All orders will be delivered at any address given by the buyer.
5.2 Delivery will be handled by PostNL. The terms and conditions of PostNL can be read at their website. For packages that are not cashed at your post office within 14 days, STRIKKS reserves the right to charge you a handling fee to cover return shipping and freight companies’ administrative costs.
5.3. On orders within The Netherlands the buyer will receive the track & trace code of its shipment.
5.4 If an item is sold out; the buyer will get a notification within two business days. In this case the buyer will always have the right to withdraw the order without any costs.
5.5 Delivery in more than one parcel is allowed.
5.6 If a delivery can not be delivered due to a wrong address given by the buyer, all extra costs are for the buyer.
5.7 Please note that local charges may occur, f.e. due to customs.

Article 6 | Personal information and privacy

6.1 Buyer must provide trader with all, correct and sufficient, information asked when placing the order.
6.2 All personal information you provide to us with or that we obtain will be handled by trader  as responsible for the personal information.
6.3 The e-mail address of the buyer may be used to provide the buyer with new information about new articles and/or future promotions. Buyer will always have the possibility to decline such information.
6.4 Personal information can be viewed and altered on the website when the order is placed using a customer profile.

Article 7 | Withdrawel and returns

7.1 Trader will take the greatest possible care when receiving and implementing any order.
7.2 If the buyer is not satisfied with its purchase, buyer may cancel the order, without stating reasons, within 14 days. To return the product(s) the buyer is given another 14 days starting the day of the cancellation. Buyer may return the product(s) to:

7.3 This period commences on the day after the product was received by or on behalf of the consumer. During this period the consumer will treat the product and its packaging with care. Make sure to include contact information and/or order number with the return.
7.4 Returning a package will start by sending an e-mail to info@strikks.nl and telling us which order you want to return.
If a returned item is shipped international, please clearly mark the package ‘RETURNED GOODS’, to avoid any Customs charges. Trader is not responsible for any return customs charges made.
7.5 The buyer is responsible for the return shipment and any other charges concerning the return. Therefore we advise our customers to send the return with registered shipping.
7.6 Buyer will return the product to the trader, with all associated components, in the original state and packaging, in accordance with the reasonable and clear instructions provided by the trader. If the product is ruined or used the product shall not be refunded.
7.7 Trader will make a refund of eligible returns if the buyer committed to all demands quoted in article 7.6 within fourteen days. Trader suggests you get a receipt and a package ID for the return from the delivery service, as it makes it easier to follow the return shipment if needed.
7.8 Buyer can not make any returns if the order was custom-made and/or personalized. However, in the case in which buyer is not fully satisfied, trader will listen and talk to buyer about these hesitations if buyer informs trader within 14 days in writing.
7.9 When booking a knitting course specific terms are applicable. 
7.10 A knitting course is one or multiple days where we teach the buyer several techniques and methods about the knitting technique. 
7.11 Trader holds all rights to annul or re-schedule the knitting course whenever there are insufficient bookings or in the case of sickness or other force majeur.
7.12 When the buyer aks for a partial annulment and trader consents, a partial, proportional refund will be made. 
7.13a Buyer is entitled to change of annul the reservation up to 30 days before the commencement of the course. A full refund will be made by trader with 14 days.
7.13b Up to 10 days before the commencement of the course buyer can make an annulment. In this case buyer is obligated to pay 50% of the purchase amount. 
7.13c Purchase amounts are not refunded when an annulment is made less than 10 days before the commencement of the course. Not even in the case of force majeur. However, buyer is given the possibility to nominate a different course participant when buyer administers all personal information details to trader. 
7.13d The right given in article 7.13c will expire when not done immediately and the open spot is given to the first person on the waiting list. 
7.13d Trader takes the best care possible for an accurate and complete management of all stock levels. 
7.14e If in the rare case of technical malfunctions or force majeur earlier given information is insufficient or incorrect and trader can not carry out the agreement, trader will send the buyer a written statement within two working days. Buyer is entitled to a full refund which will be made by trader within 14 days after the written notice. 
7.14f All courses will always be payed in advance.
7.14g When visiting the STRIKKS designstudio it is strictly prohibited to all buyers, participants and visitors to share, publish and/ or expose in any way possible all materials, products, information and knowledge that hold STRIKKS’ intellectual property. Passing on insider information to other persons internally or externally is strictly prohibited and can have legal consequences.

Article 8 | Guarantee

8.1 The trader guarantees that the products and/or services fulfill the contract, the specifications stipulated in the offer, reasonable requirements regarding reliability and/or serviceability, and statutory stipulations and/or government regulations that applied on the date on which the contract was concluded.
8.2 Buyer is obligated to check all items at delivery and within the term of its withdrawal right. If buyer has any complaints during this time period, buyer is entitled to use his withdrawal right.
8.3 A guarantee arrangement offered by the trader, manufacturer or importer does not affect the rights and claims a consumer can enforce on the grounds of the law and/or the distance contract, in relation to any failure on the part of the trader to keep to his obligations vis-á-vis the consumer.
8.4 This guarantee agreement do not apply to worn and used items and/or items that are changed or repaired or if the trader’s instructions are not followed.

Article 9 | Force majeur 

9.1 Events outside STRIKKS’s control, which is not reasonably foreseeable, shall be considered force majeure, meaning that STRIKKS is released from STRIKKS’s obligations to fulfill contractual agreements.
9.2 Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc
9.3 If trader cannot fulfill all contractual agreements but has already partially fulfilled one or more of the agreements, trader is allowed to send an invoice for that part of the delivery that has already been shipped and received by buyer.

Article 10 | Responsibility 

10.1 The trader has full responsibility until delivery. After delivery the risk it is the buyers risk. Trader cannot be held responsible for any damage caused by other parties.
10.2 Trader can only hold the buyer responsible for the invoice amount as stated on the order confirmation and buyer is therefor obliged to pay to trader.
10.3 All images en information on the website are an indication of the items portrayed/offered on the website and can not lead to any form of withdrawal of the agreement or any form of a damage compensation.
10.4 Trader cannot be held responsible for any type of damage that is a result of delivery times and products and/or services that aren’t in stock.
10.5 These determinations do not count when the damage is due to gross negligence or intent of the trader.

Artikel 11 | Intellectual property

11.1 By following these terms & conditions the buyer will have a non-exclusive usage right. Delivery of the order does not in any way stretch to any type of transmission of intellectual property.
11.2 All rights of intellectual property of the products offered on www.strikks.nl and/or are used for preparation of this agreement are held by trader (STRIKKS designer knits).
11.3 It is prohibited to make copies, alterations, modifications of the images and content of the website, in any way and in any form, unless written permission is given by STRIKKS designer knits

Article 12 | Property

12.1 Trader will remain the owner of all ordered products until the buyer has fully payed for his order. When payed, the ownership of the ordered items will pass onto him.
12.2 The Consumer may not give, sell, provide or otherwise dispose the products before the ownership has passed onto him.

Article 13 | Complaints

13.1 Trader owns a complaints procedure and will act as stated in this procedure.
13.2 After discovering a complaint buyer will immediately and if not so, within 7 days, inform trader completely and clearly.
13.3 The complaints will be answered by trader within 14 days. If the handling of a complaint takes longer than 14 days, trader will send a message to the buyer stating trader received the complaint and an indication of when buyer will receive a more explicit answer.
13.4 Complaints have to be addressed to the buyer first. If trader and buyer can not reach a satisfying solution for both parties, complaints can be addressed to the European ODR platform (http://ec.europa.eu/odr).
13.5 A complaint does not have any consequences for the duties of the trader unless trader makes a written statement beforehand.
13.6 If a complaint is to be found grounded by the trader, the trader will offer a full refund or replacement of the goods/ services.

Article 14 | Jurisdiction

14.1 All agreements are subject to Dutch law.
14.2 All possible disputes will be settled by the Dutch court in Maastricht.

Artikel 15 | Translation (prevail clause)

In the event there is a a conflict between this English version and the Dutch version of the Terms and Conditions, the Dutch version shall prevail.
